Will I still get my Stafford Loans for spring semester if I only complete 9 hours in the fall semester?

The question

I was originally taking 12, but had to withdraw in October from a course I was failing. My parents and I payed for the Fall semester. I chose not to take any of my allotted loans until Spring semester, 2012. Will this effect my ability to take those loans? According to my student account it appears that the money is still there for spring 2012, but I am panicking and cant honestly sleep from the uncertainty. I am currently enrolled in 15 hours for spring 2012
I did not use any loans or aide of any kind this semester.

As long as you are taking at least 6 credit hours in the Spring (the minimum necessary to receive loans) you will 100% receive your Stafford Loans in the Spring.

Withdrawing from a class in the Fall will not effect your Spring loans.

You should be OK, as long as you realize that if you do drop/fail classes while receiving financial aid that it will be cut the following semester – BUT, your concern should in taking 15 hrs of classes when you couldn’t handle 12 hrs.
Your loans for Spring should be fine, as long as you take 6+ credit hours and continue to meet your school’s Satisfactory Academic Progress standards. Dropping a class sometimes affects this, so check with your Financial Aid office to be sure.


Personal Bankruptcy Questions?

The question

I want to file for personal bankruptcy. But I have a question as to whether a student loan that I cosigned for my niece a year ago would qualify to be a part of this filing for personal bankruptcy.

My niece, whose parents didn’t have the best credit while she was supposed to enter college, desperately needed some form of financial aid to attend the university of her choice.

I chose to help her out and cosigned a student loan for her for one year.

Her loan payments don’t start until 2012.

I want to file for personal bankruptcy NOW.

This is because, other than my niece’s loan (which her parents, unfortunately, will not be able to pay off), I have a ton (and I mean A TON!) of debt that, with my current financial means, I know I will never be able to pay off.

My questions is, would my niece’s student loan fall under this personal bankruptcy filing if the actual student loan repayment starts in 2012?

Also, if the loan does qualify to be a part of the bankruptcy, would the student loan service come after my niece for repayment once I file for bankruptcy and it is approved?

If the student loan is government backed, then you cannot file bankruptcy on it.
Stafford, Pell, etc.
